The Expert Witness Process

The expert witness process ensures that qualified professionals address complex technical issues, contributing to fair and informed legal outcomes. Below is a simplified process of the role we play in this:

  • Evidence – Applicant: An expert report will be prepared based on inspections, document assessments, and review of legislation, BCA, and standards.
  • Evidence – Respondent: The respondent will review the expert report and respond by preparing a reply report.
  • Mediation: A joint expert conclave and mediation will be conducted to determine a potential settlement.
  • Court Hearing: If no settlement is reached, court attendance which involves cross-examination will occur.
